Hartlan Yorkies Purchase Agreement/Health
Guarantee
It is hereby agreed between Amberly Langston on behalf of Hartlan
Yorkies (hereinafter “seller”) and

(hereinafter “buyer”) as follows:
1. The seller will sell to buyer a male / female puppy from AKC litter
registration number___________________
for the purchase price of
$_______________with a non-refundable deposit of
$_________________________.

2. Every effort will be made by (seller) to insure that the puppy is
delivered in a healthy and sound condition. In order to facilitate this,
there will be an examination of the puppy by a licensed veterinarian before
the delivery of the puppy. Once puppy is shipped or personally picked up,
the buyer becomes responsible for said puppy. In order to activate the
guarantee as described herein, it will be necessary for the buyer to have an
examination by a veterinarian, at the buyer's expense within 48 hours of thepuppy leaving the seller's home and to provide proof of such examination to
seller within seven days of the date of delivery.
3. If the buyer complies with the veterinarian’s examination as set
forth in paragraph 1, then the seller guarantees the puppy until 1(one) year
of age against any life threatening congenital defects of heart, lungs and
liver only. If the puppy has a life threatening congenital defect it will be
replaced with the first available puppy of the same value from the seller,
as soon as possible. However, the original puppy must be returned (at the
buyer's expense) unharmed before a new puppy can be delivered. The buyer
will pay for the expense of sending the replacement puppy as well as the
crates or kennels used in the shipping. In the event of death, an autopsy
must be performed, (at the buyer’s expense), by a licensed veterinarian of
the seller's choice to determine the exact cause of death. A copy of the
autopsy must then be sent to the seller within 5 days of puppies death.
4. It is expressly understood that hypoglycemia is excluded from this
guarantee. The seller has informed the buyer of the signs of hypoglycemia and instructed buyer to call a licensed veterinarian for immediate care. We
also Do Not cover parasites, luxating patella’s, trachea problems, coccidia,
non-descending testicles, hernias, bites, Giardia, shipping or allergic
reactions. Color, coat, size, and weight of puppy is only a good guess based
on experience, and is not guaranteed.
5. This Guarantee is not assignable and is not valid if the puppy/dog
is sold to a third party or if the puppy/dog has been bred before the age of
one.
6. The seller is not responsible for any veterinarian bills the
purchaser may incur regarding said puppy prior to notification of the
congenital condition.
7. Seller's sole liability on the above guarantee shall be limited to
replacement with a puppy of equal value. In no event will seller be liable
for any expense incurred by the buyer. There are no refunds.
8. Other than the guarantee set forth herein, there are no other
warranties, expressed or implied.
9. The buyer agrees to NEVER sell said puppy to a pet shop, broker, or
puppy mill.
10. In the event the buyer is unable to keep said puppy for any
reason, the seller is to be given notice of the intent to sell or transfer
the puppy and an opportunity to reacquire the puppy/dog at the option of the
seller.
11. The seller agrees to provide AKC paperwork to the buyer so that
the buyer may register said puppy. Puppies are sold on limited registration
unless prior arrangements are made.
12. It is agreed and understood that the execution of this Agreement
has involved transaction of business within the state of Mississippi and
that the law of the state of Mississippi will govern the interpretation of
this Agreement.
THIS IS A LEGALLY BINDING DOCUMENT. BY SIGNING BELOW YOU ARE
ACKNOWLEDGING THAT YOU HAVE READ THIS AGREEMENT AND THAT YOU UNDERSTAND ALL OF THE TERMS SET FORTH THEREIN AND THAT YOU ARE AGREEING TO THEM.
